GTC HOTEL ARISTELLA SWISSFLAIR,
RESTAURANT SPYCHER AG

For the company:
Hotel Aristella swissflair, Restaurant Spycher AG and service booker (hereinafter referred to as GUEST).

1. Area of application

These GTC apply to all legal relationships between the Hotel Aristella swissflair, Restaurant Spycher AG and the GUEST. Furthermore, the scope of application extends to possible legal relationships between the guest and the Hotel Aristella swissflair, Restaurant Spycher, which mediates or also directly executes services.

2. Booking – Conclusion of Contract

With the acceptance of the written, telephone, electronic or personal booking and the delivery of the booking confirmation, a contract according to the Swiss Code of Obligations between the GUEST and the Hotel Aristella swissflair, Restaurant Spycher AG is concluded.
These general terms and conditions of contract are an integral part of this contract. Notifications by e-mail are deemed to have been made in writing.
Depending on the booking channel and the time of booking, different restrictions may apply with regard to minimum stay and/or availability.

3. Cancellations and rebookings

3.1 General conditions – Cancellation deadlines

Cancellations or rebookings are only valid if they are delivered in writing and confirmed accordingly in writing by the hotel. The following deadlines apply:

  • From 1 November to 30 April.
  • Changes/cancellations are free of charge up to 14 days before the date of arrival.
  • From 1 May to 30 October: changes/cancellations are free of charge up to 5 days before the date of arrival.
  • After the deadline, the hotel is entitled to charge the entire stay.

Cancellation of a reservation:

Winter season

  • Cancellation is free of charge up to 14 days before arrival.
  • From 14 days before arrival we charge you 100% of the booked arrangement.
  • In the event of late arrival or early departure, we take the liberty of charging you for the room as per your original reservation. We therefore recommend that you take out travel cancellation insurance so that you do not incur any costs in the event of a cancellation.

Summer season

  • Cancellation is free of charge up to 5 days before arrival.
  • From 5 days before arrival we charge you 100% of the booked arrangement.
  • In the event of late arrival or early departure, we take the liberty of charging you for the room as per your original reservation. We therefore recommend that you take out travel cancellation insurance so that you do not incur any costs in the event of a cancellation.

Non-refundable rate

  • The total amount must be paid immediately upon booking and is unfortunately non-refundable (but the price is cheaper).
  • In case of non-payment within 2 days, the special rate will be cancelled and we will charge the normal rate.
  • Due to the special price, the total amount remains 100% in the possession of the hotel in case of cancellation or reduction of the stay.

3.2 Early departure or late arrival

In the event of early departure or late arrival, the total amount booked will be charged.

Deposits already made will be refunded in the form of vouchers.

3.3 Cancellation date and insurance

The date of receipt of the written declaration by the booking office is decisive for the calculation of the cancellation date. In cases of hardship, the cancellation costs may be covered by cancellation insurance, provided the guest has taken out such insurance.
Cancellation insurance is the responsibility of the GUEST.

3.4 Provision of a substitute

If the booked arrangement cannot be commenced, the Hotel Aristella swissflair, Restaurant Spycher AG will accept a substitute person who will take over the existing booking under the same conditions. The substitute person must be notified to the hotel in writing. The original GUEST remains the contractual partner and is liable.

3.5 Force majeure Arrival by normal means of transport not possible

In the event of Zermatt being isolated, for reasons of force majeure, and inaccessible by all the usual means of transport, the instructions of www.hotelleriesuisse.ch will apply.

3.6 Breakdowns, operational restrictions and official measures

Disruptions such as noise and/or operational restrictions do not entitle to any compensation or refund. Also an official restriction in general e.g. closure of the wellness facility, mountain railways etc. for example due to the lack of electricity does not entitle to any price reduction.

3.7 Pandemic like COVID 19

The hotel is ONLY obliged to refund deposits if the government orders the closure of the hotels. The deposit paid will be converted into a voucher of value. This voucher has no expiry date and can be redeemed at the Hotel Aristella swissflair and the Restaurant Spycher. Only in the event of the hotel being closed will the cancellation fees also be waived for the corresponding period. Deposits already made will be refunded in the form of vouchers. The closure of the mountain railways or shops does not entitle the guest to any refund, as the hotel would be able to provide its service.

4. Price changes

Hotel Aristella swissflair, Restaurant Spycher AG may change the advertised prices in the following cases:

  • clearly explainable printing or typing errors
  • changes in exchange rates

If the prices for the booked service change after conclusion of the contract (for reasons other than those mentioned above), this is irrelevant for the concluded contract, regardless of the direction in which the price development has taken place.

5. Obligation to pay damages and liability

The Hotel Aristella swissflair, Restaurant Spycher AG is liable for damages only in cases of intent or gross negligence. Liability for items brought into the hotel is excluded to the extent permitted by law. Claims must be made in writing to the hotel immediately, at the latest 3 days after departure. Otherwise the claims shall be deemed forfeited.

6. Use of the hotel rooms

The hotel room must be used and treated with the utmost care by the guest. It may only be used or occupied by the number of persons (including children) specified in the contract. The GUEST is not permitted to allow third parties to use hotel rooms rented from Hotel Aristella swissflair. The guest shall be liable for any damage unless he can prove that such damage was caused through no fault of his own (or that of other users). Damage must be reported to the hotel immediately.

7. Use of the hotel rooms

Unless expressly agreed otherwise between the contracting parties, the earliest possible room check-in on the day of arrival is from 3:00 pm and the latest possible room check-out on the day of departure is until 11:00 am.

8. Data protection

The Hotel Aristella swissflair, Restaurant Spycher AG, process data in accordance with the Swiss Federal Law on Data Protection (DSG) and the European Data Protection Regulation (DSGVO). The uniform data protection declaration is considered an integral part of the General Terms and Conditions.

9. Transfer

The hotel is within a 10-minute walk of the railway station. The hotel has an electric trolley. However, our shuttle service is not available at all times. If you would like a pick-up service on your day of arrival, we will be happy to pick you up at the Zermatt train station or at the entrance to Zermatt village. If the shuttle is not available, we would organise a substitute for you at a charge. Hotel taxis in Zermatt are prohibited from providing any other shuttle service such as transport to the valley stations of the mountain railways.

10. Applicable law and place of jurisdiction

All contracts concluded by Hotel Aristella swissflair, Restaurant Spycher AG under these GTC’s shall be governed exclusively by Swiss law. The exclusive place of jurisdiction for any disputes arising from such contracts is Visp.

11. Dogs in the hotel

Dogs are generally allowed in the hotel. Please note that dogs are not allowed in the spa area, breakfast room and restaurant. Dogs must not be left alone in the room for a longer period of time. We charge a surcharge of CHF 20 per day, thank you for your understanding.
Food is not included in this price. Out of respect for other guests, dogs are kept on a leash in the hotel/restaurant area. The owner is liable for any damage.

12. Smoking

Since 2010 there has been a legal ban on smoking in enclosed areas throughout Switzerland. This also applies to all e-cigarettes. Our fumoir is available in the lobby 24 hours a day. Ashtrays are available on the balconies, smoking is completely prohibited in rooms with a French balcony.

The GTC shall apply in any case in accordance with the German version and any changed meanings due to the translation shall have no legal weight.
